PRIVACY POLICY

§1

GENERAL PROVISIONS

  1. Administrator of personal data collected via the Store https://somethingwhite.shoplo.com (new website: https://www.somethingwhite.pl), is Anna Nowak-Krzywańska running the economic activity under the company name Somethingwhite Anna Nowak-Krzywańska, entered into the Central Registration and Information on Business kept by the Minister in charge of Economy, place of business and delivery address: St. Marco Polo 31/19, 51-504 Wrocław, NIP: 6551931074, REGON: 385896593, electronic mail address (e-mail): somethingwhite5@gmail.com, hereinafter referred to as “Administrator”, being at the same time the Seller.
  2. Customer’s personal data is processed pursuant to act on personal data protection, date of 29th August, 1997 (Journal of Law no. 133, item 883 as amended) as well as act on provision of service by electronic means, date of 18th July, 2002 (Journal of Law no. 144, item 1204 as amended).
  3. Administrator exercises due diligence in protection of interests of the persons, whom data concerns, and in particular ensures that data collected by him/her are:
        1. processed according to law,
        2. collected for specific purposes in accordance with law and not submitted to further processing that is non-compliant with those purposes,
        3. essentially correct and adequate to the purposes, for which they are processed and stored in a manner that allows identification of persons no longer than it is required to reach the goal of processing.

4. All words or expressions stated in this Privacy Policy with capital letters ought to be understood according to their definition laid down in Terms and Conditions of the Store https://somethingwhite.shoplo.com (new website: https://www.somethingwhite.pl).

§2

THE PURPOSE AND SCOPE OF DATA COLLECTION

  1. Customers’ personal data, collected by the Administrator are used for the following purposes of:
        1. accounting,
        2. marketing (Newsletter),
        3. contacting with a Customer,
        4. other activities related to performance of the Sales Agreement.
  2. Administrator processes the Customers’ personal data as follows:
        1. Name and surname,
        2. Address (street and house/flat no., postal code, town),
        3. Telephone number,
        4. E-mail address.
  3. Administrator may process the following data characterizing a manner of the Customer’s use of services provided by electronic means (performance data):
        1. Symbols identifying end of telecom network or ICT system, which the Customer has been using.
        2. Information on the start, the end and the extent of a Customer’s each use of the service provided by electronic means.
        3. Information on the Customer’s use of services provided by electronic means.
  4. Providing personal data, which is specified in pt. 2 is necessary for the Seller to render services by electronic means within the Store or to enter into the Product Sale Agreement.

§3

THE BASIS FOR PROCESSING DATA

  1. Use of the Store, conclusion of agreements on provision of services by electronic means via Store or conclusion of Product Sale Agreements, which entail necessity of providing personal data is entirely voluntary. The data subject shall decide independently whether he/she wishes to commence use of services provided by the Seller by electronic means or conclude the Product Sale Agreement according to Terms and Conditions.
  2. Pursuant to Art. 23 of the Act on the protection of personal data, date of 29th August, 1997 processing of data is permissible e.g. when:
        1. the data subject gives his/her consent to it unless deletion of data relating to this person is concerned.
        2. It is necessary for performance of the agreement when the data subject is the party to it or when it is necessary to undertake actions before conclusion of the agreement at the data subject’s request.
  3. Processing of personal data by the Administrator always takes place on the basis of admissibility of their processing outlined in pt. 2. Data processing shall be connected to performance of the agreement or necessity to undertake actions before conclusion of the agreement at the data subject’s request. In addition, prior to conclusion of agreements on provision of services by electronic means available via the Store, a prospective Customer shall be apprised of necessity to accept the Terms and Conditions.

§4

THE RIGHT OF CONTROL, ACCESS TO OWN DATA CONTENT AND THEIR REVISION

  1. Customer is entitled to access contents of his/her own personal data and amend them.
  2. Each data subject is vested with a right to control the processing of data, contained in the Administrator’s data set, and especially a right to request supplementation, updating, rectification of personal data, to withhold or delete them temporarily or permanently if they are incomplete, outdated, incorrect or have been collected in breach of statute or they are already unnecessary to achieve the purpose, for which they have been stored.
  3. For the purpose of exercise of the rights, which are specified in pt. 1 and 2, they can be exercised by sending a relevant message to an e-mail address: somethingwhite5@gmail.com

§5

“COOKIE” FILES

  1. Store shall not collect any information automatically, except for information contained in cookie files.
  2. The cookie files constitute IT data, particularly text files, which are stored in the Store User’s terminal unit and are intended for use of Store’s websites. Cookie files usually contain the name of website, from which they are derived, time of their storage in the end device and a unique number.
  3. Entity submitting and gaining access to the cookie files on the Store User’s terminal unit is the Store operator.
  4. Cookie files are used for:
        1. adjustment of the Store websites content to a User’s preferences and optimization of websites use; in particular these files allow to identify the Store User’s device and properly display a website, suited to his/her individual needs;
        2. generation of statistics, which help understand in what way the Store Users use websites, which allows improvement to their structure and contents;
  5. Two basic types of cookie files: “session cookies” and “permanent cookies” are applied within the Store. “Session” cookies are temporary files, which are stored in the User’s end device until the time of his/her leaving the website or deactivating the software (the Internet browser). “Persistent” cookies are stored in the User’s end device for a length of time specified in cookie files parameters or until the time of their deletion by the User.
  6. The following types of cookie files are used within the Store:
          1. „essential” cookie files that enable to use services available within the Store, e.g. authentication cookies used for services requiring an authentication within the Store;
          2. cookie files used to ensure security, e.g. used for detection of frauds within the scope of authentication in the Store;
          3. “performance” cookie files that enable to collect information on the mode of usage of the Store websites;
          4. “functional” cookie files that enable to “save” the settings selected by the User and personalize the User’s interface, e.g. in terms of a selected language or region, from where the User comes, the font size, design of the website etc.;
          5. “advertising” cookie files that enable to provide Users with advertising contents better suited to their interests.
  7. Software intended for browsing websites (Web browser) allows in many cases for storing cookie files by default in the User’s end device. Users of the Store may at any time change their cookie files settings. These settings can be changes in a way to block an automatic handling of cookie files in the web browser’s settings and to notify of their every case of submitting in the unit of the Store’s User. Detailed information of possibility and methods of the handling of cookie files are available in software settings (of the web browser).
  8. Store Operator advises that limitations to the use of cookie files may affect some functionalities available on the Store’s websites.
  9. Cookie files submitted in the Store User’s end device may also be used by advertisers and partners co-operating with the Store operator.

§6

FINAL PROVISIONS

  1. Administrator applies technical and organizational means that ensure the security of processed personal data relevant to hazards and category of data being protected, and in particular protects data from disclosure to unauthorized third persons, removal by an unauthorized person, processing in breach of effective laws and modification, loss, damage or destruction.
  2. Administrator provides access to due technical means that prevent unauthorized persons from acquisition and modification of personal data transmitted in electronic form.
  3. Provisions laid down in Terms and Conditions of the Store https://somethingwhite.shoplo.com (new website: https://www.somethingwhite.pl) and other relevant regulations of the Polish law shall be applied respectively in cases unregulated by this Privacy Policy.
